1. Scope

1.1 Contracting Party

These Terms of Service (hereinafter "Terms") govern the use of the online platform SAMI-X (website and mobile apps), operated by:

1.2 Scope of Application

These Terms apply to all users of the platform, including:

Registered members
Purchasers of courses and seminars
Membership subscribers
Live training participants
Website visitors

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. Registered users will be notified of changes by email. Continued use of the platform after changes take effect constitutes acceptance.

2. Service Description

2.1 SAMI-X Platform

SAMI-X is an online platform for martial arts and self-defense training, offering the following services:

Video-based online courses
Live training sessions
Community features
Certification programs
Seminars and events

2.2 Availability

We strive for uninterrupted availability of the platform. No guarantee is made for specific availability. Maintenance work will be announced when possible.

3. Registration and User Account

3.1 Registration

The use of certain features requires registration. When registering, you agree to:

Provide truthful and complete information
Keep your data up to date
Keep your password secret
Inform us of any unauthorized use of your account

3.2 Minimum Age

Use of the platform is only permitted from the age of 18. Minors require the consent of a legal guardian.

3.3 Account Security

You are responsible for all activities under your account. If you suspect unauthorized access, please inform us immediately at office@sami.at.

4. Memberships and Subscriptions

4.1 Membership Types

We offer various membership models:

Free Membership: Limited access to selected content
SAMI International Membership: Access to exams and certifications
SAMI-X Unlimited: Full access to all online content
Instructor License: Additional content for certified instructors

4.2 Payment Terms

Payments are processed via Stripe or RevenueCat (in-app purchases)
For subscriptions, payment is made in advance for the respective billing period
Prices include applicable VAT

4.3 Automatic Renewal

Subscriptions automatically renew for the selected period unless canceled in time.

4.4 Subscription Cancellation

Subscriptions can be canceled at any time for the end of the current billing period
Cancellation can be done through your account profile or the Stripe customer portal
For in-app purchases, through the respective app store
Already paid periods will not be refunded

5. Courses, Seminars, and Events

5.1 Online Courses

Access to online courses is limited or unlimited in time, depending on the purchase model
Content may be updated or supplemented by the provider
There is no entitlement to specific content

5.2 Live Trainings and Seminars

Participation in live training requires separate registration
Cancellations are free up to 48 hours before the start
Cancellation fees may apply for shorter-notice cancellations
We reserve the right to change dates and trainers

5.3 In-Person Seminars

Additional conditions apply to in-person seminars
Risks of physical training are borne by the participant
Liability insurance is recommended

6. Usage Rights and Licenses

6.1 Granted Rights

With the purchase of a membership or course, you receive a non-exclusive, non-transferable right to personal use of the content.

6.2 Restrictions

It is prohibited to:

Download, copy, or distribute content (unless expressly permitted)
Use content commercially
Share access credentials with third parties
Circumvent technical protection measures
Use the platform for illegal purposes

6.3 Copyright

All content on the platform (videos, texts, graphics, logos) is protected by copyright. The rights belong to SAMI International or the respective licensors.

7. User Content and Community

7.1 User Content

You can create your own content on the platform (e.g., comments, photos, videos). You are solely responsible for your content.

7.2 License to User Content

By uploading content, you grant SAMI International a non-exclusive, worldwide, royalty-free right to use this content on the platform.

7.3 Code of Conduct

When using community features, you agree to:

Treat other users with respect
Not publish offensive, discriminatory, or illegal content
Not spread advertising or spam
Not publish personal data of third parties

7.4 Moderation

We reserve the right to remove content without giving reasons and to suspend user accounts in case of violations.

8. Liability and Assumption of Risk

8.1 ⚠️ IMPORTANT SAFETY WARNING - WEAPON-BASED TRAINING

The SAMI-X platform offers instructional content that includes training with weapons such as knives, axes, sticks, and other potentially dangerous implements. By accessing this content, you explicitly acknowledge and accept the following:

Inherent Dangers: Training with weapons, even with training replicas, carries significant risk of serious injury or death. These risks exist regardless of your skill level or experience.

No Supervision: Online training cannot provide the real-time supervision, correction, or intervention that in-person instruction offers. You are solely responsible for your safety during training.

Training Equipment: You must use appropriate safety equipment and training replicas (rubber/foam weapons) whenever possible. Using sharp or real weapons during training dramatically increases injury risk.

Training Environment: You must ensure your training area is:

Free of obstacles, breakable objects, and bystanders
Adequately sized for the movements being practiced
Away from children, pets, and uninvolved persons

Physical Readiness: You must assess your own physical condition, limitations, and readiness before each training session. Do not train while fatigued, impaired, or unwell.

8.2 Assumption of Risk and Release of Liability

BY USING THE SAMI-X PLATFORM AND ITS TRAINING CONTENT, YOU VOLUNTARILY ASSUME ALL RISKS associated with martial arts and self-defense training, including but not limited to:

Cuts, bruises, sprains, fractures, and other physical injuries
Injuries from training with or near weapons (knives, axes, sticks, etc.)
Injuries from falls, impacts, or improper technique execution
Injuries caused by training partners, if applicable
Property damage resulting from training activities
Long-term or permanent physical impairment
In extreme cases, death

YOU EXPRESSLY RELEASE AND DISCHARGE SAMI International, its instructors, employees, affiliates, and content creators from any and all claims, demands, or causes of action arising from your use of the training content, except where such release is prohibited by law.

8.3 No Guarantee of Results or Safety

The techniques demonstrated are for educational purposes only
Effectiveness of self-defense techniques cannot be guaranteed in real-world situations
No training program can eliminate the risk of injury during practice or application
Individual results vary based on physical condition, dedication, and proper application
The platform does not warrant that any technique is suitable for your specific situation

8.4 Limitation of Liability

To the maximum extent permitted by applicable law:

SAMI International's total liability for any claims arising from your use of the platform shall not exceed the amount you paid for the specific content or service giving rise to the claim in the 12 months preceding the claim.

SAMI International shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, pain and suffering, or emotional distress.

Liability for slight negligence is excluded, except for damages resulting from injury to life, body, or health where such exclusion is not permitted by law.

8.5 Health and Medical Disclaimer

Consult a physician before beginning any physical training program
If you have any pre-existing medical conditions, injuries, or physical limitations, seek medical clearance before training
Stop immediately if you experience pain, dizziness, shortness of breath, or any unusual symptoms
The platform provides fitness and martial arts information, NOT medical advice
Nothing on this platform should be construed as a substitute for professional medical advice

8.6 Parental/Guardian Responsibility

If you permit a minor (under 18) to access training content under your supervision:

You accept full responsibility for their safety
You must directly supervise all training activities
You assume all risks on their behalf
You release SAMI International from any claims related to their training

8.7 Platform Availability

We assume no liability for interruptions, failures, or unavailability of the platform.

9. Right of Withdrawal

9.1 Withdrawal Information

Consumers have a right of withdrawal of 14 days for online purchases.

9.2 Exceptions to the Right of Withdrawal

The right of withdrawal expires for digital content if you have expressly agreed that the provider may begin performing the contract before the withdrawal period expires.

9.3 Withdrawal Form

To exercise your right of withdrawal, contact us at office@sami.at with a clear statement (e.g., letter or email) of your decision to withdraw from this contract.

10. Data Protection

The processing of your personal data is carried out in accordance with our Privacy Policy.

11. Final Provisions

11.1 Applicable Law

Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Place of Jurisdiction

The place of jurisdiction for all disputes is, insofar as legally permissible, Vienna, Austria.

11.3 Severability Clause

If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.

11.4 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
